Terms and conditions of use

Glad to have you here. These terms explain the rules for using Moka. We've written them as clearly as we could, but they matter: please read them carefully.

1. Who we are and what these terms are

These Terms and Conditions of Use ("Terms") govern the use of the mokapet.tech website ("Site") and, once it launches, of the Moka app for Android ("App"), along with the services related to them (all together, the "Services"), offered by the Moka project ("Moka", "we", "us").

By accessing or using the Services, you confirm that you have read, understood and agree to these Terms. If you don't agree with them, please don't use the Services.

Some features may have rules of their own, such as the beta test, purchases in the App or the artificial intelligence features. When that is the case, those rules will be shown before you use them and add to these Terms.

2. Definitions

To make reading easier, we use these words with these meanings:

  • "You" or "User": the person who accesses or uses the Services.
  • "Moka": the character, a pixel art little monster, and also the project that runs the Services.
  • "Moka Content": the character, name, logo, artwork, animations, sounds, texts, lines, scenery, minigames and code of the Services.
  • "Overlay": the App feature that makes Moka appear on your phone screen on top of other apps.
  • "Coins" and "virtual items": the currency and the objects used inside the App, such as foods, clothes and decorations.

3. Who may use the Services

The Services are suitable for all audiences and recommended from age 13 and up.

If you're under 18, use the Services with your parents' or guardians' knowledge and permission; they are also responsible for your use and for any purchases.

We don't knowingly collect personal data from children under 12 without the consent of a parent or guardian, as Brazil's General Data Protection Law (LGPD) requires. If you find that this has happened, contact us and we'll delete the data.

4. What Moka offers

The Site presents the project and lets you interact with Moka and play a minigame, for free.

The App, still in development, is a virtual pet: you look after Moka (food, baths, sleep and fun), visit his home, play minigames and can let him live on your phone screen through the Overlay.

For the Overlay to work, the App asks for permission to appear over other apps and, if you want, to send notifications. We explain what each permission is for before asking, and you can turn them off at any time in your phone's settings. In the current version, Moka does not capture or read the content of your screen or of your other apps.

The Site is free. The App may have free features and paid features; prices and conditions of any paid feature will be shown clearly before purchase.

5. Account and access

The Site doesn't require signing up.

To keep your progress, the App may create an anonymous identifier, without asking for your name or email. If accounts with sign-in exist in the future, the sign-up rules will be shown beforehand.

You're responsible for keeping your device and your access secure, and for what is done through them.

6. Rules of use

Moka is meant to be light and fun for everyone. So, when using the Services, you agree not to:

  • break laws or regulations, or other people's rights;
  • try to break in, get around security, exploit flaws or overload the Services;
  • copy, modify, decompile or reverse engineer the App or the Site, except where the law expressly allows it;
  • use bots, scrapers or other automated means to extract content in bulk;
  • cheat or tamper with coins, items, scores or progress, or sell or trade accounts and items outside the Services;
  • use Moka's name, character or brand to pretend to be us or to mislead others;
  • send content that is illegal, offensive, discriminatory, violent or that invades someone's privacy;
  • use the Services for commercial purposes without our written permission.

If these rules are broken, we may take appropriate measures, such as limiting or suspending access, without prejudice to other actions provided by law.

7. Coins and virtual items

Coins and virtual items are a limited license for use inside the App. They are not money, have no value outside the App, can't be exchanged for money and can't be transferred to other people.

We may adjust how much is earned and how much things cost inside the App to keep the game balanced.

If there are purchases with real money, they will be made through the app store and follow the conditions shown at the time of purchase, with all your consumer rights preserved.

8. Waitlist and beta test

When you join the waitlist, you get an email to confirm your signup. Only after you confirm do we keep your email and the site's language, to tell you about the beta and the launch. You can leave the list whenever you want, through the unsubscribe link in our emails or by writing to us; the details are in the Privacy and Cookies Policy.

Test (beta) versions exist precisely to find problems: they may have bugs, lose progress or change a lot before launch. Taking part is voluntary and may end at any time, by you or by us.

We may ask you not to share features we haven't announced yet. Your feedback on the test is very welcome and helps us make Moka better.

9. Artificial intelligence features

In the future, Moka may talk with you through artificial intelligence (Moka Plus). When that feature exists:

  • messages will be processed by an artificial intelligence provider (currently Anthropic's Claude) only to generate Moka's replies;
  • Moka is a fictional character: he is not a person and will never pretend to be one;
  • replies are generated automatically and may contain mistakes, so they shouldn't be taken as absolute truth;
  • Moka doesn't give professional advice, whether medical, psychological, legal or financial;
  • if you're going through a hard time or are at risk, reach out to a professional or an emergency service; in Brazil, CVV answers at 188, free, at any hour.

This feature's specific rules, including the privacy of conversations, will be shown before you use it.

10. Your data and your privacy

We handle personal data in accordance with Brazil's General Data Protection Law (Law No. 13,709/2018).

The Site only handles your personal data when you write to us through the contact form or join the beta waitlist, and only uses analytics cookies (Google Analytics) if you accept them. The Privacy and Cookies Policy explains it all in detail: which data, what for, with whom it is shared, how long it is kept and how to change your choices.

When the App starts handling personal data, the Privacy and Cookies Policy will be updated beforehand.

You have the right, among others, to confirm whether we handle your data, to access it, correct it, ask for it to be anonymized, blocked or deleted, to request its portability, to know whom it was shared with and to withdraw consent. Just write to our contact email.

11. Suggestions and content you send

We love ideas. If you send us suggestions, comments or opinions about Moka, you allow us to use them freely to improve the Services, with no obligation to pay or to give credit.

If you send any content through the Services, you confirm that you have the right to send it and that it doesn't infringe anyone else's rights.

12. Intellectual property

Moka Content is protected by copyright, trademark and intellectual property laws, and belongs to the Moka project or is used with permission.

We grant you a personal, free, limited, non-exclusive and revocable license to use the Services for entertainment, for non-commercial purposes. No rights are transferred to you beyond what these Terms allow.

Sharing links, screenshots and videos of you playing, for personal use, is welcome. So are non-commercial fan art and fan content, as long as they don't pass themselves off as official. Any other use, especially commercial, needs written permission.

13. Third-party services and links

The Services rely on third-party services, such as hosting, fonts, the app store and, in the future, artificial intelligence and payment providers. Each has its own terms and policies; using Google Play, for example, is subject to Google's terms.

The Site may link to third-party sites. We don't control those sites and aren't responsible for their content or practices.

14. Availability, changes and termination

Moka is in development. We may change, suspend or end features of the Services, including what the Site shows about the App, which may change until launch. When a change is significant, we'll give notice in advance whenever possible.

We may suspend or end the access of anyone who breaks these Terms.

You can stop using the Services whenever you want, simply by no longer visiting the Site or by uninstalling the App.

15. Disclaimers and limitation of liability

The Services are provided "as is" and "as available". We work to make them run well, but we don't guarantee that they will always be available, uninterrupted or error-free.

To the fullest extent permitted by law, we're not liable for indirect damages, for losses caused by failures of your device, your connection or third-party services, or for interruptions beyond our control.

Nothing in these Terms removes or limits the rights the law grants you as a consumer, or our liability in cases where the law does not allow such a limitation.

16. Communications

If you give us your email, we may use it for matters related to the Services, such as telling you the test is open or answering your message. News and marketing messages will only be sent with your consent, and you'll be able to unsubscribe at any time.

17. Changes to these Terms

We may update these Terms to keep up with changes in the Services or in the law. The date of the last update is at the top of this page. If a change is significant, we'll let you know clearly. Continuing to use the Services after an update means you accept the new version.

18. General provisions

  • If any clause of these Terms is found invalid, the others remain in force.
  • If we don't enforce a rule, that doesn't mean we waive it.
  • You may not transfer your rights or obligations under these Terms to someone else without our permission. We may transfer ours if the project is reorganized, for example when a company is created, while keeping your rights.
  • These Terms, together with the specific rules of each feature and the Privacy and Cookies Policy, form the entire agreement between you and Moka about the Services.

19. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of your place of residence will have jurisdiction over any matter related to them, as Brazil's Consumer Protection Code provides.
